1. Agreement to these terms
These Terms of Service form a binding agreement between you and Gigilau. By creating a Gigilau account or using the Gigilau AI platform, you accept them. If you are agreeing on behalf of a company, you confirm you have the authority to bind that company.
If you do not accept these terms, please do not use the service.
2. The service
Gigilau provides AI-assisted generation of text, images, speech and code through the Gigilau AI platform. Features, models and limits vary by plan and are described on our pricing page. We improve and change the platform continuously; we will give reasonable notice before removing a feature you rely on.
3. Accounts
You must be at least 16 years old to hold an account. You are responsible for the accuracy of your account details, for keeping your credentials secret, and for everything that happens under your account. Tell us promptly at [email protected] if you suspect unauthorised access.
4. Acceptable use
You agree not to use Gigilau AI to:
- create content that is unlawful, defamatory, or that infringes someone else’s rights;
- generate sexual content involving minors, or content that sexualises real people without consent;
- produce malware, exploits, phishing pages or other material designed to cause harm;
- impersonate a real person or organisation, including by cloning a voice without documented consent;
- generate targeted harassment, or content that incites violence or hatred;
- circumvent rate limits, resell platform access, or reverse-engineer the service;
- upload content you do not have the rights to use.
We may suspend or terminate accounts that breach this section, and we will cooperate with law enforcement where the law requires it.
5. Your content and generated output
You keep all rights in the prompts, files and reference material you provide (“Input”). You grant Gigilau a limited licence to process the Input solely to operate the service for you.
Subject to your compliance with these terms, Gigilau assigns to you whatever rights it may hold in the material the platform produces for you (“Output”), and paid plans include full commercial usage rights with no attribution requirement. Free-plan images include a Gigilau watermark.
Two practical caveats. First, AI output may not be copyrightable in every jurisdiction, and we cannot promise that it is. Second, similar prompts can produce similar results for different users, so we cannot guarantee that Output is unique to you.
6. Accuracy and your responsibility
Gigilau AI can be wrong. It can state facts that are false, produce code that does not compile or that contains security flaws, and generate images that misrepresent reality. The Output is a starting point, not a finished professional product.
You are responsible for reviewing Output before you publish, ship or rely on it, particularly in medical, legal, financial or safety-critical contexts. Where the law requires you to disclose AI-generated content, doing so is your responsibility.
7. Payment and cancellation
Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled. Prices exclude VAT and other local taxes unless stated otherwise. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and your account reverts to the free Starter plan.
We refund unused paid time if we materially fail to deliver the service. We do not otherwise refund partial periods. We will give at least 30 days’ notice by email before changing the price of your plan.
8. Intellectual property
The Gigilau platform — its software, models, interface, documentation, name and logo — belongs to Gigilau and its licensors and is protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable right to use the service, and nothing more. You may not copy the platform, use our trademarks without written permission, or use Output to train a competing model.
9. Availability and support
We aim for high availability but do not promise uninterrupted service on Starter or Pro plans; scheduled maintenance is announced in advance where practical. Enterprise customers receive a contractual uptime SLA of 99.9% with service credits, set out in their order form.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.
Gigilau is not liable for indirect, incidental, special or consequential damages, nor for lost profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the greater of (a) the amount you paid Gigilau in the twelve months before the event giving rise to the claim, or (b) USD 100.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
11. Termination
You may close your account at any time. We may suspend or terminate your account for a material breach of these terms, for non-payment, or where required by law — with notice where circumstances allow. On termination your right to use the service ends immediately; you can export your content for 30 days, after which it is deleted.
12. Governing law and changes
These terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, without prejudice to any mandatory consumer protections in your country of residence.
We may amend these terms; material changes take effect 30 days after we notify you by email or in the product. Continuing to use Gigilau after that date means you accept the revised terms.
